Brain Injury

Because every brain injury is unique, determining the long-term medical costs of brain injuries is never an exact science. Insurance companies don’t like to deal with the many unknowns of brain injury, and they will often decline (or “fail to authorize”) tests, procedures, surgery and therapy that could help doctors fully evaluate a suspected brain injury victim. Because early detection of a brain injury is so critical for recovery, the obstacles and delays that many insurance companies place in front of injury claims can have tragic consequences for brain injury victims and their families.

Norfolk and Virginia Beach, Virginia attorney Joe Perez offers victims of brain injury legal representation against negligent parties and the companies that insure them.  Many of his clients have suffered brain injuries as a result of car accidents, truck accidents, on-the-job injuries or medical mistakes that could have been prevented.  Joe’s job is to make sure that nothing prevents his clients from obtaining the maximum amount of compensation they deserve.  Many families in Norfolk, Chesapeake, Newport News, Virginia Beach and the Tidewater area have thanked Joe for the job he’s done and the difference he’s made in their lives.  If your family needs similar help in coping with the legal, medical and financial difficulties of a brain injury, contact Joe today.

More About Brain Injuries

The human brain is the most powerful organ in the body, and its vast complexity is what distinguishes humans from the rest of the animal kingdom.  But the brain is also the most delicate human organ, and medical therapy and treatment of head and brain injuries is usually a long and involved process that rarely results in full recovery of the brain’s faculties.

Between 50,000 and 100,000 Americans suffer serious and life lasting brain injuries every year.  The majority of these injuries are sustained in traffic accidents at high moving speeds.  In such accidents, violent head-first collisions with windshields, dashboards, and car roofs can leave victims in the very worst of medical conditions – where the brain registers little to no activity and the person is kept alive through artificial means and life support.  Other severe brain injuries result in extended comas, permanent loss of speech, loss of hearing and loss of cognizance.

Not all traumatic brain injuries are the result of the head colliding with something hard at high rates of speed.  Near accidents and sudden stops that don’t involve collisions can cause acceleration/deceleration injuries (“whiplash”), which, in addition to neck, spine, back and shoulder injuries, can also cause mild traumatic brain injuries.  In such cases, the soft tissue of the brain slams against the hard bone and cartilage of the skull, resulting in bruising, bleeding and tearing of the intricate tissue, vessels and nerves that comprise the brain.

Often, the first obstacle for many brain injury victims is determining that they have a brain injury at all.  Closed head injuries are difficult to detect, especially in cases where the brain injury occurred at the microscopic level.  There are, after all, billions of blood vessels and nerve cells in the brain.  Even using some of today’s most advanced medical tests – such as CAT scans and MRI's – doctors sometimes miss critical injuries in the initial examination of a brain injury victim.  This is why it is so essential for doctors to schedule a follow-up examination for anyone who has been involved in a potential closed head injury accident.

Early detection of a brain injury is important because the brain doesn’t heal very well by itself.  This is because the brain is housed in the skull, which doesn’t expand or absorb the excess blood and fluid that the injury releases into the area between the brain and skull.  With no place to go, this fluid exerts pressure against other parts of the brain, causing further pain, damage and disability to the victim.  Again, only rapid medical detection and surgery can prevent a brain injury victim from permanent brain damage and disability.
